This document, including all text, diagrams, wiring schematics, tables, calculations, technical data, methodologies, procedures, and all other content contained herein (collectively, the “Document”), is the exclusive intellectual property of **Macrotec Engineering (Pty) Ltd** (“Macrotec Engineering”), and is protected by applicable copyright law, intellectual property law, and international treaties, including but not limited to the Berne Convention for the Protection of Literary and Artistic Works, the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), and the applicable national copyright and intellectual property legislation of the jurisdictions in which Macrotec Engineering operates.
All right, title, and interest in and to this Document, including all intellectual property rights therein, are and shall remain the sole and exclusive property of Macrotec Engineering. No transfer or assignment of any intellectual property rights is made or implied by the distribution, display, or provision of this Document to any party.
2. Restrictions on Use
This Document is provided solely for the internal use of the authorised recipient in connection with the specific project or engagement for which it was issued by Macrotec Engineering. Except as expressly authorised in writing by an authorised officer of Macrotec Engineering, the recipient shall not:
1. Reproduce — Copy, duplicate, scan, photograph, or otherwise reproduce this Document in whole or in part, in any medium or format, whether now known or hereafter developed.
2. Distribute — Distribute, circulate, publish, transmit, forward, or otherwise make this Document available to any third party, including but not limited to competitors, subcontractors, consultants, or any person or entity not directly named as an authorised recipient.
3. Modify — Alter, adapt, translate, edit, annotate, create derivative works from, reverse-engineer, or otherwise modify this Document or any portion thereof, including the removal or alteration of any proprietary notices, watermarks, or attributions.
4. Commercially exploit — Use this Document or any content therein for commercial purposes, including but not limited to incorporating the content into competing products, services, guidelines, manuals, training materials, or consulting deliverables, whether for sale, licence, or free distribution.
5. Claim authorship — Present, represent, or imply that this Document or any portion thereof was authored, developed, or originated by any person or entity other than Macrotec Engineering.
3. Permitted Use
The authorised recipient may:
- Use this Document for reference in the design, installation, and commissioning of electrical systems directly associated with equipment supplied by Macrotec Engineering, for the specific project for which this Document was issued.
- Make a reasonable number of printed copies for use by qualified personnel directly involved in the aforementioned project, provided that all proprietary notices and this Legal Disclaimer are reproduced in full on every copy.
- Quote brief excerpts (not exceeding 200 words) in internal project reports, provided that Macrotec Engineering is cited as the source and copyright owner.
- Any use beyond the scope of these permitted uses requires the prior written consent of Macrotec Engineering.
4. Confidentiality
- This Document contains proprietary technical information, methodologies, engineering procedures, and know-how developed by Macrotec Engineering. The recipient acknowledges that this information constitutes confidential and proprietary information of Macrotec Engineering and agrees to:
- Treat this Document with at least the same degree of care used to protect the recipient’s own confidential information, but in no event less than reasonable care.
- Restrict access to this Document to those employees, agents, or representatives who have a legitimate need to know in connection with the authorised project and who are bound by confidentiality obligations no less protective than those contained herein.
- Not disclose the content of this Document to any third party without the prior written consent of Macrotec Engineering.
5. Enforcement & Remedies
Unauthorised reproduction, distribution, modification, commercial exploitation, or any other use of this Document in violation of the restrictions set forth herein constitutes an infringement of the intellectual property rights of Macrotec Engineering and may give rise to:
1. Civil remedies — including but not limited to claims for injunctive relief, damages (including consequential and exemplary damages), account of profits, and legal costs, in accordance with applicable intellectual property and copyright legislation.
2. Criminal liability — Wilful copyright infringement may constitute a criminal offence under the applicable national legislation, including but not limited to the South African Copyright Act (No. 98 of 1978, as amended), the UK Copyright, Designs and Patents Act 1988, the US Copyright Act (17 U.S.C. §§ 501–513), and equivalent legislation in other jurisdictions. Criminal penalties may include fines and imprisonment.
Macrotec Engineering reserves the right to pursue all available legal remedies against any person or entity that infringes its intellectual property rights in relation to this Document.
6. Third-Party Standards & References
This Document references international standards published by the International Electrotechnical Commission (IEC), the European Committee for Electrotechnical Standardisation (CENELEC), the National Fire Protection Association (NFPA), the British Standards Institution (BSI), and other standards bodies. All such references are made for informational and educational purposes and constitute fair use. The referenced standards remain the intellectual property of their respective publishers, and this Document does not reproduce any substantial portion of those standards. Users are directed to obtain the full text of any referenced standard from the relevant publisher.

This Legal Disclaimer and all matters arising from or relating to the intellectual property rights in this Document shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict-of-law provisions. Any disputes arising under this notice shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
